1. Who we are
This store is operated by SALUBELL PHARMA, S.L. ("Salubell", "we"), a Spanish company with tax identification number B30752646 and registered office at Avda. del Carbono, 44, Parcela 96, Pol. Ind. Los Camachos Sur, 30369 Cartagena (Murcia), Spain. Our full details are set out in our Legal Notice.
Salubell operates this website and all of its content, features, tools, products and services (the "Services"). The site is powered by Shopify.
2. Purpose and acceptance
These Terms and Conditions govern the purchase of products on salubell.com and the use of the Services. Please read them carefully before placing an order: by confirming it, you agree to be bound by them.
The following policies, available on this website, form an integral part of these Terms: our Shipping Policy, our Refund and Returns Policy, our Privacy Policy and our Cookie Policy. Where these Terms and any of those policies differ on a matter that the policy governs specifically, the policy prevails.
3. Access and account
To buy from our store you must be of the age of majority under the law of your country of residence.
When you place an order we will ask for certain details, such as your email address, billing address, payment method and delivery address. You undertake to provide accurate, current and complete information and to keep it up to date.
You are responsible for safeguarding your account credentials and for the activity carried out through your account. You may not transfer, sell or assign it to third parties.
4. Our products
We do our best to make product images and descriptions as faithful as possible. However, colours and appearance may vary depending on the device and screen settings you use.
Descriptions, composition and formats may change. Where they do, the binding information is that shown on the product page at the time you place your order and that stated on the label of the product you receive.
We may discontinue any product and limit the quantities available per person, geographical area or jurisdiction, in particular where the law of a country restricts the marketing of certain food supplements.
Food supplements should not be used as a substitute for a varied and balanced diet or a healthy lifestyle. The information published on this website is for information purposes only and does not replace advice from a healthcare professional.
5. Formation of the contract
By confirming an order you make an offer to purchase. The contract is formed when we send you the order acceptance confirmation by email.
We may decline an order where the product is unavailable, where we detect an obvious error in the price or description, where we cannot serve the address given, or where there are reasonable grounds to suspect fraud or purchase for resale. If we decline, amend or cancel an order, we will tell you using the contact details you provided and refund in full any amount charged.
You confirm that your purchases are for personal or domestic use and not for resale or export for commercial purposes.
6. Prices, taxes and billing
Prices are shown in euros and include the taxes applicable to the destination, unless stated otherwise. The tax treatment of each destination, including cases where import taxes are payable by the recipient, is set out in our Shipping Policy.
Shipping costs are calculated and itemised before you confirm your order.
The applicable price is the one in force when you place your order, as stated in the confirmation email. Prices, discounts and promotions may change without notice, without affecting orders already confirmed. Promotions are governed by their own terms, which prevail over these Terms on the matters they specifically regulate.
You confirm that the payment information you provide is true and complete and that you are authorised to use the payment method indicated.
7. Shipping and delivery
Destinations, estimated times, delivery deadlines and shipping costs are set out in our Shipping Policy.
We undertake to deliver within the deadline stated for each destination. If we fail to do so, you may ask us in writing to deliver within an additional reasonable period and, if that period is also missed, terminate the contract with a full refund.
We are responsible to you for delivery of the order, including where the delay originates with the carrier. We are released only in cases of force majeure.
Risk of loss of or damage to the goods passes to you when you, or a third party indicated by you other than the carrier, take physical possession of the order. If you appoint and engage a carrier yourself, from options we did not offer you, risk passes on delivery to that carrier.
8. Right of withdrawal
Under Spanish Royal Legislative Decree 1/2007 and Directive 2011/83/EU, you have the right to withdraw from the contract without giving any reason. We extend the statutory period of 14 days and give you 15 calendar days from receipt of the order.
To exercise it, simply tell us your decision by an unequivocal statement before the period expires, writing to clientes@salubell.com or using our withdrawal form, which you are not obliged to use. Once you have told us, you have 14 calendar days to send the goods back to us.
There is no right of withdrawal over sealed products whose seal has been broken after delivery, for reasons of health protection or hygiene.

9. Statutory guarantee of conformity
We are liable for any lack of conformity of the products under applicable law. If you reside in Spain, the statutory guarantee is three years from delivery. If you reside in another European Union Member State, two years. If you reside in the United Kingdom, you also have the right to reject a faulty product within 30 days of delivery.
If a product arrives faulty, damaged or not as ordered, we bear the cost of returning it and of the replacement shipment, in accordance with our Refund and Returns Policy.
10. Intellectual and industrial property
The Services and their content, including text, images, graphics, video, audio, trade marks, logos and the design, selection and arrangement of all of them, belong to Salubell or to its licensors and are protected by Spanish and international law.
These Terms allow you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, copy, publicly display, republish, download, store or transmit that content without our prior written consent.
11. Comments and reviews
If you send us comments, suggestions or reviews, you grant us a free, worldwide, sublicensable licence to use, reproduce, adapt and publish them in connection with providing and improving the Services and promoting our products.
You confirm that you hold the necessary rights over that content, that you have disclosed any compensation or incentive received in connection with it, and that it does not infringe third-party rights.
We may moderate or remove comments that are unlawful, offensive, defamatory or obscene, or that infringe third-party rights. Product reviews are not edited or filtered on the basis of their rating.
12. Prohibited uses
You may access and use the Services for lawful purposes only. In particular, the following are prohibited:
- Using them for unlawful or malicious purposes, or breaching applicable law.
- Infringing the intellectual property rights of Salubell or of third parties.
- Harassing, insulting, defaming or intimidating employees or other people.
- Transmitting false or misleading information, or impersonating third parties.
- Sending unsolicited mail, uploading viruses or malicious code, or interfering with the security features of the Services.
- Collecting other users' personal data without their consent.
13. Third-party tools and links
The Services may give access to third-party tools over which we exercise no control, provided as they are and subject to availability, and may contain links to external websites. We are not responsible for the content or operation of those sites and tools. We recommend reviewing their terms before using them.
14. Relationship with Shopify
This site is powered by Shopify, but any sale and purchase is made directly with Salubell. Shopify is not a party to the contractual relationship between you and us.
15. Data protection
Personal data processed through the Services is governed by our Privacy Policy.
16. Errors, inaccuracies and omissions
Published information may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, shipping costs or availability. We reserve the right to correct them and to update the information at any time.
If an order already confirmed is affected by an obvious pricing error, we will tell you and you may choose between keeping the order at the correct price or cancelling it with a full refund.
17. Limitation of liability
To the extent permitted by applicable law, Salubell is not liable for indirect or consequential loss arising from use of the Services.
This limitation does not in any way affect the rights that Spanish and European law grant consumers on a non-waivable basis, nor our liability for wilful misconduct or gross negligence, for lack of conformity of the products, for personal injury or for defective products.
18. Suspension and closure of your account
We may suspend or close your account, with prior notice and on justified grounds, where you materially breach these Terms, in particular the prohibited uses section, or where there are well-founded indications of fraud. If suspension is urgent for security reasons, we will tell you as soon as possible.
Suspension or closure does not affect orders already confirmed or the rights you hold in respect of them.
19. Amendment of these Terms
We may update these Terms. We will publish the version in force on this page with its date of update. Amendments have no retroactive effect: each order is governed by the Terms in force when it was placed.
20. Severability, waiver and assignment
If any provision of these Terms is held void or unenforceable, it will be severed without affecting the validity of the remainder. Our failure to exercise a right does not amount to a waiver of it.
You may not assign this contract without our prior written consent. Salubell may assign it on giving you reasonable notice, provided this does not diminish your rights or the guarantees available to you.
21. Applicable law and jurisdiction
These Terms are governed by Spanish law. If you are habitually resident in another European Union Member State, this choice does not deprive you of the protection afforded by the mandatory consumer provisions of your country of residence. If you reside in the United Kingdom, it does not deprive you of the protection of UK consumer law.
Where you are a consumer, the courts of your place of residence shall have jurisdiction. In all other cases, the parties submit to the courts of the city of Murcia (Spain).
22. Complaints and dispute resolution
For any complaint, please write to us at clientes@salubell.com. We handle complaints within a maximum of 4 working days of receipt.
Please note that SALUBELL PHARMA, S.L. has signed up to the Consumer Arbitration Board of the Region of Murcia (Junta Arbitral de Consumo de la Región de Murcia), which settles financial and similar disputes between consumers and businesses, retailers or professionals. It forms part of the Spanish Consumer Arbitration System, which operates in every Autonomous Community in Spain. Further information is available on the website of the Autonomous Community of the Region of Murcia.
If you reside in another European Union Member State, you can consult the list of consumer alternative dispute resolution bodies notified to the European Commission at consumer-redress.ec.europa.eu, or contact the European Consumer Centres Network (ECC-Net) for cross-border disputes. If you reside in the United Kingdom, you may refer the matter to an approved alternative dispute resolution body or to Trading Standards through Citizens Advice.
